Is anyone familiar with the process for surrendering the airworthiness certificate to the FAA so that the aircraft may be public use? We obtained a military surplus TH-67 with a standard airworthiness certificate. The logistics involved in the numerous technological modifications being made to the helicopter have apparently made that a desirable option for our maintenance side of the house. I can't find an FAA form for the process but understand that a letter of explanation must accompany the surrendered certificate. Any guidance would be greatly appreciated.

Hello Ted,
There is no need to remove the airworthiness certificate from a civil aircraft if you are doing public missions. A civil certificated aircraft can go in and out of public aircraft operations from flight to flight, provided it remains in the proper mechanical and documentary condition for civil operations. I take it you have modified the aircraft so it is not possible to retain civil certification parameters. If that is the case I'd just ask your local FSDO what they think you should do. As is sometimes the case, the FSDO people on the local level may have to research this. If you follow this link you may find what you need. As long as the aircraft is not being sold out of the country you may be able to keep it on the off chance that you might someday return it to it's civil certificated conformation and sell it. You'd have a bigger market if that is possible. Let us know what you find out.

I should also point out that although Advisory Circular AC 00-1.1A is written to address civil operators who contract with public agencies, you might also consider notifying your FSDO of your use of the aircraft for only those flights that qualify as public aircraft operations per the US code. Then ask them the question about the civil certificate.

Will the 1033 Program even allow you to surrender the certificate? They own the aircraft. If its ever transfered and youve done mods to it outside of what the standard air worthiness certificate would allow LESO may have an issue with that. If it can be done, I would start with LESO first since they are the owner. Not the FSDO.
